The Tamale High Court has ordered a rerun of the Kpandai parliamentary election, directing that a fresh poll be conducted within 30 days from today.
The ruling, delivered by His Lordship Emmanuel Brew Plange, follows a legal challenge to the outcome of the 2024 parliamentary election in the constituency. The petition, filed by former Member of Parliament and National Democratic Congress (NDC) Parliamentary Candidate Daniel Nsala Wakpal, contested the election of Matthew Nyindam as MP.
Wakpal argued that the parliamentary election held on December 7, 2024, was invalid due to significant irregularities in both the voting and collation processes. He cited inconsistencies on FORM 8A (Regulation 32(7) and 39(2) – Statement of Poll and Declaration of Results for Parliamentary Elections, commonly known as the Pink Sheet) for 41 out of the 152 polling stations in the constituency.
According to him:
- The election was not conducted in compliance with Regulation 39 of the Public Elections Regulations, 2020 (C.I. 127), and the non-compliance affected the results.
- The declaration and publication of results also failed to meet the requirements of Regulation 43 of C.I. 127, rendering the entire outcome unreliable.
Wakpal therefore sought an order invalidating the results from the affected 41 polling stations and requested a rerun limited to those centres.
After examining the evidence, Justice Plange upheld the petition and ordered the Electoral Commission to conduct a new parliamentary election in the constituency within the mandated 30-day period, to determine the legitimate winner.
