The National Youth Organiser of the New Patriotic Party (NPP), Henry Nana Boakye, popularly known as Nana B, has sharply criticised the High Court judge who ordered a rerun of the parliamentary election in the Kpandai constituency, describing the ruling as unjust, flawed, and an act of judicial overreach.
Justice Emmanuel Bart Plange Brew of the High Court in Tamale directed the Electoral Commission (EC) to conduct a fresh parliamentary election for the Kpandai seat. Following the judgment, Parliament on Monday, December 8, 2025, formally notified the EC of a vacancy in the constituency.
Speaking to journalists in Accra on Tuesday, December 9, Nana B accused the judge of mishandling key legal principles—particularly the burden of proof—during the trial.
According to him, the petitioner who challenged the election results admitted involvement in acts of vandalism that contributed to the relocation of the collation centre, yet the court failed to hold him accountable.
“This is not interpretation; this is dictatorship from the bench,” Nana B asserted. “Clearly, in this case, you could see that the burden of proof was cynically manipulated by this judge. The court refused to find the petitioner who led the vandalism that forced the EC to relocate the collation center.”
He further criticised the court’s evaluation of alleged electoral irregularities, insisting that the ruling relied on speculation rather than evidence.
“Miraculously, when assessing the irregularities that affected the results, speculation became acceptable, vague and unsubstantiated assertions were deemed sufficient. The petitioner produced no credible tally,” he added.
The High Court’s decision has stirred debate across political circles, with the NPP and NDC offering sharply contrasting interpretations of its implications for electoral integrity and precedent within the constituency.
The Electoral Commission is yet to announce a date for the rerun election.
