SML Petitions CHRAJ Over Alleged Abuse of Power by Special Prosecutor’s Office

Strategic Mobilisation Ghana Limited (SML) has filed a formal petition with the Commission on Human Rights and Administrative Justice (CHRAJ), accusing the Office of the Special Prosecutor (OSP) of administrative injustice, abuse of power, and violations of due process during its investigation into revenue assurance contracts awarded by the Ghana Revenue Authority (GRA).

The petition, submitted on Wednesday, November 12, 2025, alleges that the OSP—particularly its lead investigator, Mr. Albert Akurugu—conducted a biased and hostile investigation that resulted in significant damage to SML’s operations and infringed on its constitutional rights, including the right to property and fair administrative treatment.

According to the petition, the dispute dates back to 2017, when failures in the then-existing West Blue customs management system led to major revenue leakages. SML was subsequently contracted to help seal the loopholes and reportedly recovered over USD 1.35 million within its first two months of work. The company claims that Mr. Akurugu, a former employee of West Blue, harbored personal animosity over its replacement, which allegedly influenced the OSP’s conduct.

SML alleges that on June 10, 2025, OSP operatives raided its offices in Osu and Tema, destroying servers, firewalls, and other critical digital infrastructure. The petition claims that CCTV systems were dismantled, effectively erasing potential evidence and disrupting ongoing audits and business operations.

The company further accuses the OSP of publishing an investigative report that misrepresented SML’s work, unfairly portrayed its leadership, and minimized the systemic failures of West Blue. It alleges that Mr. Akurugu openly threatened to ensure SML and its CEO, Evans Adusei, “never work again,” and vowed to permanently disable the company’s servers.

SML is requesting CHRAJ to:

  • Investigate the alleged administrative injustice and abuse of power
  • Hold responsible public officials accountable
  • Examine potential oversight failures by the Special Prosecutor, Mr. Kissi Agyebeng
  • Compel the release of video recordings from interrogation sessions for independent review
  • Recommend sanctions against any officials found culpable

In verifying the petition, CEO Evans Adusei affirmed that the statements and facts presented were accurate to the best of his knowledge.

Meanwhile, the OSP has filed 78 charges against eight individuals, including former Finance Minister Ken Ofori-Atta, in connection with the controversial revenue assurance contracts between the GRA and SML. Others facing prosecution include former GRA Commissioners-General Dr. Ammishaddai Owusu-Amoah and Emmanuel Kofi Nti, senior officials Isaac Crentsil and Kwadwo Damoa, former Technical Advisor at the Ministry of Finance Ernest Akore, SML owner Evans Adusei, and SML itself.
