Attorney-General Appeals Court of Appeal Ruling Halting Trial of Hanan Abdul-Wahab and Wife

The Attorney-General has appealed against a Court of Appeal ruling ordering a stay of proceedings in the trial of former National Food and Buffer Stock Company Chief Executive Officer, Hanan Abdul-Wahab, and his wife, Faiza Sediu Wuni.

The Court of Appeal, presided over by Justice Noble Nkrumah, with Justices Lydia Osei Marfo and George Boadi serving as members of the panel, upheld an application argued by Godfred Dame on behalf of Hanan Abdul-Wahab, ruling that it raised exceptional circumstances warranting a stay of proceedings.

In its decision, the court also underscored the importance of a charge sheet in criminal proceedings and the need for any challenge to it to be addressed expeditiously.

Dissatisfied with the ruling, the Attorney-General has filed an appeal, arguing that the Court of Appeal erred in its decision, particularly in holding that a challenge to a charge sheet constitutes exceptional circumstances.

The prosecution is seeking, among other reliefs, an order quashing the Court of Appeal’s ruling and directing the High Court to resume proceedings in the trial of Abdul-Wahab and his wife.
