The Supreme Court has finally released its full ruling on the most controversial issue on Mr Gyakye Quayson’s election as member of parliament. As a result of a case of dual citizenship, the Supreme Court ruled that Mr Quayson was unqualified to contest as a member for the Assin north constituency.
Defying the odds, he won the seat but the court ruled saying it was unconstitutional for him to be elected as member of parliament . Parliament was thereby directed by the Supreme Court, presided by Justice Dotse, to expunge his name from the house and further declare the seat vacant. For this reason, the electoral commission will hold a by-election on June 27.

The court in its findings realized Mr Quayson had not shown evidence of his denouncement of being a Canadian citizen as directed but was granted permission by the electoral commission to contest in the 2020 election, thereby , stating that the electoral commission acted unconstitutionally. The 7 member court in a unanimous ruling said, one must at the time of nomination hold only a Ghanaian citizenship and not any date after. They also established that, no one with a dual citizenship is qualified to contest in a Ghanaian election unless they show proof of their denouncement before filing.
